Acceptable Use Policy

1. Purpose
This Acceptable Use Policy sets the rules for using Fidella safely, lawfully, and fairly. It applies to everyone who uses Fidella and is incorporated into the Consumer Terms of Service and the Merchant Agreement. Breaching it may lead to content removal, reversal of improperly obtained value, suspension, or termination, and may be reported to authorities where required.
2. General lawful-use rule
You must use Fidella only for lawful purposes and in compliance with all applicable laws, including consumer-protection, privacy, marketing, intellectual-property, and anti-money-laundering laws in New Zealand and Australia.
3. Prohibited conduct
You must not:
- use Fidella to commit or facilitate fraud, theft, money laundering, terrorism financing, or any other crime;
- obtain, inflate, or redeem stamps, points, rewards, or vouchers to which you are not genuinely entitled, including by manipulating loyalty rules, exploiting bugs, or using automated means;
- impersonate any person or business, or misrepresent your affiliation or authority;
- access, use, or administer sites, dashboards, or data you are not authorised to access;
- probe, scan, or test the vulnerability of the platform, or breach or circumvent security or authentication;
- introduce malware, or interfere with, overload, or disrupt the platform or its infrastructure (including scraping beyond what we permit, denial-of-service, or reverse engineering except to the extent the law allows despite this restriction);
- misuse QR codes, voucher codes, or wallet credentials, or share them to enable unauthorised redemption;
- infringe any intellectual-property, privacy, publicity, or other right of any person; or
- use Fidella to send unlawful, unsolicited, or deceptive communications.
4. Content standards
- If you submit content (for Merchants: business/site details, offers, promotions, branding, and images), you must not submit content that is hateful, harassing, discriminatory, defamatory, obscene, sexually explicit, violent, deceptive, misleading, or otherwise objectionable or unlawful.
- You represent and warrant that you own or hold all rights, licences, and consents necessary for the content you submit and that it does not infringe any third party’s rights.
5. Moderation
- Fidella may screen, moderate, withhold from display, or remove any content at its sole discretion, with or without prior notice, where it reasonably considers the content breaches this policy or creates legal or reputational risk. Moderation may be automated, manual, or both.
- A Fidella moderation decision is a platform-level control exercised in the interests of Fidella and the customer community. It overrides any Merchant-side approval workflow, and a Merchant cannot release or reverse a Fidella moderation hold.
6. Enforcement and reporting
- Where we reasonably believe you have breached this policy, we may (proportionately): remove content; reverse or withhold improperly obtained value; restrict features; suspend or terminate accounts; and preserve and disclose information where required by law or to protect rights and safety.
- Where practicable and lawful, we will tell you the reason for an enforcement action. Serious or repeated breaches may result in permanent termination.
